These Terms and Conditions ("Terms") govern your use of the website and services offered by Radiant Innovation LLC, doing business as Radiant Innovation Studio ("we", "us", "our"), a New Mexico LLC (File #: 3033707), located at 1209 Mountain Road PL NE, STE R, Albuquerque, NM 87110. By accessing our website or purchasing our services, you agree to be bound by these Terms.
Services
Radiant Innovation Studio provides web design, web development, brand identity, e-commerce, landing page, and web application services for businesses and individuals. The scope, deliverables, and timeline for each engagement are defined in a Statement of Work ("SOW") or confirmed upon order completion.
For digital package purchases (Launch $499, Grow $990, Scale $1,490), deliverables are as specified on our Pricing page at the time of purchase. We reserve the right to update service descriptions; changes do not apply retroactively to confirmed orders.
Payment Terms
All fees are quoted in US Dollars (USD). Payments are processed securely by Stripe, Inc. We accept Visa, Mastercard, American Express, Discover, and PayPal.
Digital package purchases (website packages priced at $499, $990, or $1,490): Full payment is due at time of order. Work commences within 2 business days of confirmed payment.
Custom engagements: A non-refundable deposit of 50% is required before work begins. The remaining balance is due upon project completion before final files and deployment are delivered. Milestone payments may be structured as agreed in the SOW.
Overdue invoices are subject to a 1.5% monthly late fee. We reserve the right to suspend work on projects with overdue balances.
Revisions & Project Changes
Each package includes a defined number of revision rounds (Launch: 2, Grow: 4, Scale: 6). A revision round is a consolidated batch of feedback addressed in one pass. Additional revisions beyond the included rounds are billed at $120/hour.
Significant changes to project scope after commencement ("scope creep") will be quoted separately and require written agreement before work proceeds.
Intellectual Property
Upon receipt of full payment, all custom design and code created specifically for your project transfers to you. You will own the final deliverables outright.
We retain ownership of: (a) our pre-existing tools, frameworks, templates, and methodologies used in delivering your project; (b) any designs, mockups, or code created but not selected during the revision process; (c) rights to display completed work in our portfolio unless you request otherwise in writing.
You represent and warrant that all content, images, and materials you provide to us are owned by you or properly licensed and do not infringe any third-party intellectual property rights.
Client Responsibilities
Timely project delivery depends on your cooperation. You agree to provide required materials (content, images, brand assets, access credentials) by agreed deadlines, designate a primary point of contact with authority to approve work, and review and respond to deliverables within 5 business days. Delays caused by your inaction may result in revised timelines and potential additional charges.
Warranties & Limitation of Liability
We warrant that our services will be performed in a professional manner consistent with industry standards. We do not warrant that our services will meet all of your requirements or that results will be error-free, uninterrupted, or achieve specific business outcomes.
OUR TOTAL LIABILITY to you for any claim arising from these Terms or our services shall not exceed the total amount you paid us in the 12 months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Refunds
Our refund policy is detailed at radiantinnovationstudio.com/Refund-Policy. By making a purchase, you acknowledge and agree to our Refund Policy.
Termination
Either party may terminate a project engagement with 14 days written notice. Upon termination, you will pay for all work completed to the termination date at our standard rates, plus the non-refundable deposit. We will deliver all work product completed as of the termination date within 5 business days of final payment.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of law provisions. Any dispute shall first be attempted to be resolved through good-faith negotiation. If unresolved after 30 days, disputes shall be submitted to binding arbitration in Bernalillo County, New Mexico under the American Arbitration Association's Commercial Arbitration Rules.
